You can receive information about your data stored by us at any time free of charge, as well as your right to correction, deletion, restriction of the processing of your data or your right to data transferability. For this purpose, please refer to the contact data mentioned above.

If you wish to object to the collection, processing or use of your data by Biogena in accordance with these data protection regulations as a whole or for individual measures, you can also address your objection by e-mail, fax or letter to the contact data mentioned above.

You also have the right of appeal to a supervisory authority if you believe that the processing of personal data concerning you is unlawful. You may exercise this right before a supervisory authority in the Member State where you are living, working or at the place of the alleged infringement.

2. Personal Data

Personal data is information about the objective or personal circumstances of a specific or identifiable natural person. Statistical data that we collect when you visit our web shop, for example, and which cannot be directly linked to your person, are not included here.

Personal data, such as your name, your address, your telephone number, your e-mail address and other inventory data, which you give us in the context of your online registration, your order, your newsletter registration and your inquiry via our contact form, are collected and processed by us, insofar as this is necessary for the processing of your registration and/or your order, your newsletter registration or the answering of your question.

We collect, store and process your data for the entire duration of the fulfilment of your purchase or enquiry, including any subsequent warranties, for our services and in accordance with the legal (in particular tax law) retention periods. Newsletters and electronic advertising will be sent out until revoked.

Your data will not be passed on to third parties unless Biogena is entitled or obliged to pass them on for legal reasons. Excluded from this is the necessary transfer of data by Biogena to service providers commissioned with the organisational or technical processing of the order or the execution of goods deliveries, e.g. banks, post office or parcel services, as far as this is necessary for the delivery of the goods. The data passed on in this way may only be used by our service providers to fulfil their task. Any other use of the information is not permitted and will not be made by any of the service providers entrusted by us.

If, in exceptional cases, companies of the Biogena Group or data processors are located outside the European Economic Area, we take care to ensure an appropriate level of data protection and compliance with the relevant data protection regulations. No further data transmission to a third country is planned.

The processing purposes in detail:

2.1. Online registration in our webshop

Purchases in our webshop and the use of our watch list are possible after successful online registration in our Biogena Club (for consumers) or our partner area (for doctors and therapists).
By confirming your online registration, you voluntarily agree that Biogena (for consumers) may process your data in your interest, for the purposes of managing your club benefits or (for doctors and therapists) to contact you via email and telephone through our Partner Service Center regarding your registration and cooperation possibilities.

Your online access is password protected. Here you can view data about your completed, open and recently sent orders and manage your collected loyalty points, your personal data as well as a subscription to the newsletter, if required.

You agree to treat the personal access data confidentially and not to give them to unauthorized third parties. We cannot accept liability for misused passwords, unless we are responsible for the misuse. Please note that you will remain logged in automatically if you do not log out.

2.2. Purchase completion

By completing your online order, you expressly permit us to process your personal data for fulfilling your purchase and sending your order. We need your e-mail address so that we can confirm the receipt of your order. We also use these for your identification (web login). You will also receive your order and shipping confirmation via your e-mail address. We also need your e-mail address and telephone number to be able to communicate with you in the case of queries regarding your order or in case of delivery problems.

2.2.1. Customer survey – your feedback is requested

4 weeks after your order, you will receive an invitation to a voluntary customer survey, from which you can unsubscribe at any time with effect for the future. The data obtained from this is evaluated anonymously and provides important feedback to enable us to adapt our products even more closely to the needs of our consumers and to support our scientific team.

2.3. Newsletter Subscription / Receipt of electronic advertising

By confirming your subscription to the newsletter, you voluntarily agree that the following companies of the Biogena group of companies may process your data for the purposes of sending electronic newsletters and receiving electronic direct advertising and personalised advertising about Biogena products, events and services: Biogena GmbH & Co KG, Nolimits Digital Business GmbH, Biogena Akademie GmbH, Biogena Check Up Lounge Österreich GmbH, Biogena Check Up Lounge Deutschland GmbH. Personalised advertising means customised advertising for you and your interests. We use existing information, such as your region of residence, your registration date and your customer group (consumer or physician/therapist) to send you only advertisements for products that might be of interest to you.
A registration for the Biogena newsletter (newsletter of Biogena GmbH & Co KG and Biogena Akademie GmbH) is only possible if you have actively consented to its receipt. We use the so-called double opt-in procedure for sending the newsletter, i.e. we will only send you a newsletter by e-mail if you have expressly confirmed to us beforehand that we are supposed to activate the newsletter service. We will then send you a notification e-mail and ask you to confirm if you would like to receive our newsletter by clicking on a link within this e-mail.
If you no longer wish to receive newsletters from us, you can unsubscribe at any time free of charge. A message in text form to the contact data (e.g. e-mail, fax, letter) mentioned under point 1 is sufficient for this. Of course you will also find a unsubscribe link in every newsletter.

2.4. Inquiries via contact form

If you send us an enquiry using the contact form, Biogena will process the personal data you have provided exclusively for the purpose of processing your request and - if necessary to respond to your enquiry - will forward it to the responsible company in the Biogena group of companies.
Since the requests via contact forms can be of various types, we need at least the information from you which are defined as mandatory fields in the contact form.

3. Server log data

When you visit our website, log data that does not allow us to draw any conclusions about your person are automatically logged and temporarily stored. This data includes e.g. browser type and version, referrer URL, abbreviated IP address, provider name and operating system used. All log data is evaluated anonymously exclusively for statistical purposes, to improve our offer, to facilitate troubleshooting and to prevent attacks on our web shop by us or the service provider commissioned by us.

4. Cookies 

In order to make our website user-friendly (web analysis) and to enable the use of certain functions, such as our web shop or our product watch list, we use so-called cookies in some areas.
Cookies are small datafiles which are stored locally on your data carrier and which store certain settings and information for exchange with our system via your browser.
Most of the cookies we use are session cookies and are deleted from your hard drive after you close your browser. The long-term cookies we use remain stored on your hard drive for 30 days and are deleted afterwards. When you return for another visit, it will automatically recognize that you have already visited our website and which entries and settings you prefer.

5. Google Analytics and Google Adwords

This website uses Google Analytics, a web analysis service of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google). The use includes the Universal Analytics mode. Google Analytics uses so-called cookies.
On behalf of the website operator, Google will use the information generated by the cookies to evaluate your use of the website, to compile reports on activities and to provide other services associated with the use of the website and the Internet. Our legitimate interest in data processing also lies in these purposes. The legal basis for the use of Google Analytics is Art. 6 Par. 1 lit. f DSGVO. After 14 months, the data transmitted by us and which are linked to cookies, user IDs (e.g. user ID) or advertising IDs are automatically deleted. Data whose retention period has been reached is automatically deleted once a month.

We also use the online advertising program "Google AdWords" and as part of Google AdWords the conversion tracking from Google. If you click on an ad served by Google, a conversion tracking cookie is placed on your computer. These cookies lose their validity after 30 days, do not contain any personal data and are therefore not used for personal identification.
If you visit certain pages of our website and the cookie is not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. Each Google AdWords customer receives a different cookie. This means that it is not possible to track cookies on the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have decided to use conversion tracking. Customers only see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they will not receive any information that personally identifies users.

6. Facebook Pixel / Remarketing / Retargeting

8. Use of myfonts

The design of our website also uses external fonts provided by MyFonts Inc, 600 Unicorn Park Drive, Woburn, MA 01801, USA (hereinafter: MyFonts). These fonts are integrated by a server call to MyFonts. When you visit our website, at least your IP address is transferred to a MyFonts server in order to transfer the font files to your browser. 10. Terms and conditions social media competitions

Social media competitions (especially on Facebook) are organised by Biogena GmbH & Co KG, Strubergasse 24, 5020 Salzburg (hereinafter: "Biogena"). Participation in competitions is only possible under the conditions listed here. By participating, the participant expressly accepts these conditions of participation:

  1. Contests have no connection with Facebook and are in no way sponsored, supported or organized by Facebook. The recipient of the information provided by the participant is not Facebook, but Biogena as operator of the Biogena GmbH & Co KG Facebook page and organizer of the competition. The information provided will only be used for the competition.
  2. The start and end dates (implementation period) of the competition can be found in the respective competition post.
  3. The prizes which can be won are those defined in the competition post, an exchange, a cash payment as well as legal recourse are excluded. Winnings are usually sent by post.
  4. The voluntary participation in the competition is done through a comment (picture or text) and/or like on our Facebook post regarding a competition. Multiple comments from the same user will be counted as a single participation.
  5. participants are persons residing in Austria or Germany who are at least 18 years old and a fan of Biogena GmbH & Co KG on Facebook. You become such a fan by pressing the Like button on the Biogena GmbH & Co KG Facebook page. Employees, authorised representatives, legal successors and representatives of Biogena GmbH & Co KG, involved agencies and their relatives are not entitled to participate.
  6. participants are persons residing in Austria or Germany who are at least 18 years old and a fan of Biogena GmbH & Co KG on Facebook. You become such a fan by pressing the Like button on the Biogena GmbH & Co KG Facebook page. Employees, authorised representatives, legal successors and representatives of Biogena GmbH & Co KG, involved agencies and their relatives are not entitled to participate.
  7. The drawing of the prize will take place after the end of the implementation period under exclusion of the public and guarantee of the random principle. The participation in the draw requires a comment or like.
  8. The winner will be informed via the Facebook comment function of the Facebook post on Facebook or via Facebook Messenger. 11. Note on video surveillance

The foyer of the Biogena headquarters in Strubergasse 24, 5020 Salzburg as well as the entrance and sales areas of the Biogena Stores are video-monitored for the preventive protection of persons and objects against vandalism and legally punishable acts. The acquired image data is only stored for a period of 72 hours. Image data will only be stored for longer than 72 hours if this is necessary to pursue legal claims. A passing on to other recipients is not permitted. The data is stored on a network hard disk. The data evaluation is password-protected and only occurs in certain cases.
